The Trustee of the Reich
Minister of Economics for the Ignaz Petschek Production Companies

In answer to the questions put to me in
yesterday's conference I inform you of the following:
1. The directive
in the decree of the Reich Minister of Economics of 19 January 1939, according
to which you are to sell your industrial enterprise [Gewerbebetrieb] by 28
February 1939 2 is mainly of formal importance. Again I ask you to submit to me
proposals for the sale of your enterprise by the date mentioned above. These
proposals should not refer only to the sale of certain parcels of stocks which
are in your possession, but on the contrary, they have to apply to the sale of
the enterprise itself; that is the mines, the briquette plants, and all
accessories. I want to stress once more that my consent is required to initiate
negotiations for the sale or liquidation of the enterprise.
2. It will
be superfluous to call a general meeting.
3. As to the problem of
acquiring the real estate, I expect a settlement which will serve the
operational interests of the companies. It is acknowledged by a representative
of the Reich Ministry of Economics that an exception will have to be made for
the period of trusteeship. The exact farm of this exception will be specified
later. |

__________ ¹ When this document was
offered in evidence, prosecution counsel stated the conditions under which it
had been found, saying among other things: "It is a carbon copy of a letter
written by the trustee and it was found clipped together with the preceding
document" [Tr. p. 1811). It was also stated that the file in which the document
was found was available for inspection by the defense [Tr. p. 1808]. ²
